How does Prodigy Maintain FERPA Compliance?

FERPA is ‘The Family Educational Rights and Privacy Act. FERPA requires that federally funded institutions, under programs administered by the U.S. Department of Education, comply with certain procedures with regard to disclosing and maintaining educational records.

FERPA was designed to protect the student’s educational information and status as a student. It protects the privacy of students’ “Educational Records” by specifying how and with whom schools can share information from these records.

FERPA says that schools cannot share student information without parental consent. Without that written consent, FERPA only allows a school to share student information if an ‘exception’ is met. The two most common exceptions specified by FERPA are: the “Directory Information” and “School Official” exceptions.

  • Under FERPA, schools can use either the “School Official” exception or the parental consent approach to share some information with third parties that provide a legitimate educational function.
  • Both the “School Official” exception or parental consent approach are used by many districts with well-known education technologies.
  • Prodigy’s Terms of Use are written to support either approach in order to ensure that all parties are complying with FERPA.
  • Finally, Prodigy’s policies also confirm that no student information will be shared with any other third parties unless they aid in providing the Prodigy service. The service agreements with each third-party service provider are reviewed annually.
